Terms of Service

This English version is a non-binding translation. In case of dispute, the Spanish original ("Aviso Legal" / "Política de Privacidad" / "Términos" / "Política de Cookies") prevails.

1. Parties

Provider: Martin Schenk S.L., CIF B84645654, C/ Claudio Coello 14, 5g, 28001 Madrid, Spain. Contact: legal@martin-schenk.es.

Customer: natural or legal person who registers an account on mindbeamer.io.

2. Scope of service

MindBeamer is a multi-tenant SaaS platform that, for each customer project:

  • analyses the brand from URL and/or description.
  • suggests three content categories (editable by the customer).
  • generates posts (theme, text, hashtags, Unsplash image) for approval.
  • publishes approved posts to the Facebook and Instagram pages the customer has connected via Page Access Token.

3. Pricing and subscription

Single tier — €19/month per project (VAT included).

  • Monthly: €19/month, no minimum term, cancel anytime.
  • Yearly: €190/year (equivalent to 2 months free).
  • Free trial: 14 days with card required at subscription start. No charge if you cancel before day 14. Email reminder 3 days before trial ends.
  • One project = one brand / one domain / one topic. Multiple independent brands require multiple projects (separate subscriptions).

4. Invoicing

Payments are processed via Stripe. The official tax invoice under Spanish law is issued by Martin Schenk S.L. via Zoho Invoice (in future, Contix.es), with the customer's tax ID and details when provided. Invoices are sent by email and viewable in the customer panel.

5. Customer obligations

  • Provide accurate, up-to-date data (including VAT ID for B2B).
  • Connect only Facebook / Instagram accounts you have a commercial right to use. The Page Access Token is provided under the customer's own responsibility.
  • Review and approve each post before publication. Posts published via MindBeamer appear as the customer's own content on their social profiles.
  • No use for illegal, misleading, offensive, discriminatory content or content that violates the Facebook / Instagram Community Standards.
  • No unauthorised access attempts, reverse engineering or flooding of the platform.

6. Limitation of liability

MindBeamer provides AI-generated suggestions. The customer is always ultimately responsible for the final content published, reviewing and approving each post. Martin Schenk S.L. is not liable for:

  • Errors, exaggerations or tone mismatches by the AI versus the customer's desired brand voice.
  • Outages, suspensions, policy changes or permission revocations by Facebook, Instagram or any third party.
  • Damages arising from the use of content published by the customer on their social profiles.

Except in cases of wilful misconduct or gross negligence, Martin Schenk S.L.'s maximum liability is limited to the amount paid by the customer in the 12 months preceding the event giving rise to the claim.

7. Cancellation and consequences

You may cancel your subscription at any time from the customer panel. Cancellation takes effect at the end of the currently invoiced period. No prorated refunds for unused days (except where legally required).

After cancellation, Facebook / Instagram connections are disabled and tokens deleted immediately. Project data is kept for 30 days in case you reactivate the account; afterwards it is deleted (except for legal retention obligations).

8. Right of withdrawal (consumers)

For consumer customers in the EU: by purchasing a digital service with immediate execution, the customer expressly consents that we begin performance before the 14-day withdrawal period ends — leading to loss of the right of withdrawal once the contract is fully performed (Art. 103 LGDCU).

9. Changes to the Terms

We may update these Terms to reflect legal, technical or service changes. We will notify you by email at least 30 days in advance. If you disagree, you may cancel before they take effect.

10. Jurisdiction and governing law

Spanish law applies. For consumers, the courts at the consumer's domicile have jurisdiction. For businesses, the place of jurisdiction is Madrid, Spain.
